1. Agreement to Terms

By accessing or using PestLog ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

PestLog provides cloud-based pesticide application logging and record-keeping software designed to help pest control professionals comply with EPA regulations and maintain accurate chemical application records.

3. User Accounts

Account Creation

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to use the Service
  • You must be a licensed pest control professional or authorized operator

Account Security

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized access
  • We are not liable for losses due to unauthorized use of your account

4. Subscription and Payment

Free Trial

New users receive a 30-day free trial. No credit card is required during the trial period.

Paid Subscriptions

  • Subscriptions are billed monthly or annually as selected
  • Payments are processed through Stripe
  • Prices are subject to change with 30 days notice
  • All fees are non-refundable except as required by law

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial months or unused time

5. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Upload malicious code or viruses
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer or copy any part of the Service
  • Resell or redistribute the Service without permission

6. Your Data and Content

Ownership

You retain all rights to the data and content you submit to PestLog. We do not claim ownership of your chemical application logs, customer information, or other data.

License to Us

You grant us a limited license to store, process, and display your data solely to provide the Service to you.

Data Accuracy

You are responsible for the accuracy and legality of all data you enter. PestLog is a tool to help you maintain records - you remain responsible for EPA compliance.

7. Intellectual Property

The Service, including its software, design, text, graphics, and other content, is owned by PestLog and protected by copyright and trademark laws. You may not copy, modify, or distribute any part of the Service without our permission.

8. Disclaimers and Limitations

Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Regulatory Compliance

While PestLog is designed to help with EPA compliance, we do not guarantee that using the Service will ensure full compliance with all applicable regulations. You are responsible for understanding and complying with all relevant laws.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PESTLOG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify and hold PestLog harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may suspend the Service for maintenance, updates, or unforeseen issues. We are not liable for any downtime or data loss.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason. Upon termination, you may export your data within 30 days, after which it will be permanently deleted.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the state where PestLog is registered, without regard to conflict of law provisions.
